Terms and Conditions
General
By making a purchase through our website, you accept these terms, agree to be bound by them, and acknowledge that a contract is formed between us and you for the purchase of the Goods, the terms of which are these Terms and Conditions.
The Terms and Conditions may be amended at any stage without notice. Your use of the website following any amendments to these Terms and Conditions is deemed to be an agreement to the terms and conditions as they exist at the time of your purchase.
We are not responsible for any loss you may suffer, including missing or lost products, where that loss occurs because the information you provided is incorrect. At all times it remains your responsibility to ensure that all information provided to us, whether at the time of registering for an account, or when completing a transaction, is accurate.
Price
Prices are shown in Australian Dollars (AUD) and include GST where applicable.
Prices do not include any delivery charges.
Delivery charges and product prices are subject to change in our absolute discretion.
Errors published on the website will be corrected without notice. This includes any pricing errors after a purchase has been made.
Payment
All orders must be paid in full before the scheduled date of delivery or pick up.
Title to, and right to possession of all Goods remains with us until we have received the full purchase price for the Goods.
All credit card payments attract a 2% fee.
Credit card fees are non-refundable.
Delivery
Standard Delivery is to Sydney Metro only. Additional fees and charges apply for delivery outside of Sydney Metro.
We aim to have Sydney Metro deliveries fulfilled within 1-3 business days for items that are in stock.
We aim to have deliveries outside of Sydney Metro fulfilled within 2-5 business days for items that are in stock.
Regional areas outside of a major capital city can take up to 20 business days.
Delivery is to Ground Floor only. Difficult delivery locations will incur additional charges.
Missed delivery will incur a redelivery fee.
Some products may not be available for immediate delivery and in these circumstances may need to be ordered. Where extended delays occur, we will endeavour to contact you to advise.
Where available you may choose to collect Goods in person. Where you elect to do so, we will advise you when the Goods are ready to be collected.
We are not required to refund the purchase price for Goods purchased by you as a consequence of delays in delivery which are outside our control. You acknowledge that where Goods are a special order, or are an international/interstate import, extended delays may occur.
In circumstances where we are unable to supply the goods you have ordered due to unavailability, we may cancel your order without charge and we will arrange for a full refund of any payment made by you to be processed.
Credit card fees are non-refundable under any circumstance.
We may, in our absolute discretion, refuse to provide any Goods, where:
– Those Goods are unavailable for any reason;
– You are in breach of these Terms of Service;
You are responsible for ensuring that all information provided to us, including delivery address, is correct. We are not liable for any loss or damage incurred to you as a consequence of incorrect information supplied by you.
We are not liable for any loss, damage, or delay occasioned to you as a consequence of late or non-delivery of the Goods.
We are not responsible for delays to deliveries where that delay is caused by a Third Party Carrier. Where delivery is being made by a Third Party Carrier, we may not be able to provide an exact delivery time outside of an estimated day.
We are not responsible to you, or any person claiming through you, for any loss or damage to Goods in transit caused by any event of any kind by any person (whether or not we are responsible for the actions of that person), where that delivery is made by a Third Party Carrier.
Warranty
Installation of all products purchased from us are to be installed by a licensed and qualified person relevant to your state. Manufacturers installation instructions must be followed. We do not accept responsibility for damage caused to a product due to incorrect installation from an unlicensed or unqualified person.
In order to claim warranty on a product, a certificate of compliance must be produced prior to making the claim. The existing installation must comply with local rules and regulations. Products must not be removed or uninstalled if a warranty claim is being made. We have the right to refuse a warranty claim if the above is not adhered to.
Returns/Refunds
All return claims to be made within 30 calendar days of Purchase. All returns/refunds of purchased goods are subjected to a 30% restocking fee and is subjected to approval by Atomic Hot Water Repairs. Items must be in original packaging and unopened. Special ordered products are non-refundable.
Where refunds are approved, subject to returns conditions above, credit card fees are non- refundable.
It is the purchaser’s responsibility to organise postage for returns at their own cost.
General Continued
Acceptance of Goods or Service: Whether by verbal agreement, signature on quotation/invoice, deposit paid or full payment made or expressed in writing, is deemed to be an acceptance of these terms and conditions and any variation thereto, must be communicated in writing and treated as an addition to this contract.
All goods shall remain the property of Atomic Hot Water Repairs until payment is received in full. Full payment is required upon completion of work. All credit card payments attract a 2% fee.
Installation of any of the products purchased from us are to be installed by a licensed and qualified person relevant to your state. We do not accept responsibility for damage caused to a product due to incorrect installation from an unlicensed or unqualified person.
All quotations valid for 30 days only, unless approved by Atomic Hot Water Repairs. Upon acceptance of a quotation, a deposit of 10% is required prior to works commencing. All deposits paid to Atomic Hot Water Repairs are non-refundable.
Fees and charges are subject to change without prior notice. Additional fees and charges shall apply for work commencing outside of normal business hours. Normal business hours are 7:30am to 3:30pm Monday to Friday and 8am to 12pm Saturday. Warranty related bookings are only between Monday to Friday 7:30am to 3:30pm, subject to availability at the time of booking.

All quoted works are subject to variations as required and are at the discretion of Atomic Hot Water Repairs in order to carry out and complete works to comply with Australian Standards and Work, Health and Safety Standards. All variations will incur additional fees and charges to the original quoted amount. It is the responsibility of the client to obtain all permits, licenses and approvals, at their own expense, that may be required for the works (i.e. strata, councils or other governing agents). Any costs arising from but not limited to Strata or local council by-laws will be charged in addition to the quoted price.
The client agrees that the site will comply with any Work Health and Safety laws relating to building/construction sites and any other relevant safety standards or legislation.
No responsibility is accepted by Atomic Hot Water Repairs nor does the quoted work include any costs or liability in relation to the replacement, repair or sustainability of existing Plumbing, Electrical, Fluing, Piping, Floor Covering, Wiring, Roofing or any other household effects. Whilst all care is taken, there is always a risk of damage to property, Atomic Hot Water Repairs does not accept any responsibility for damage to property during works being carried out. You agree to not hold Atomic Hot Water Repairs liable for any damage that may occur as a direct or indirect result of works carried out.
Should circumstances beyond our control prevent or hinder delivery of goods and/or service, Atomic Hot Water Repairs shall not be held liable for any obligation to deliver goods and services while such circumstances continue. For as long as, in our opinion, such circumstances exist, we may, at our option, cancel, rescind or terminate all or any part of the contract or keep the contract on foot until such circumstances have ceased. Such circumstances beyond our control include, but are not limited to: strikes, lockouts, rebellions, fire, acts of God, shortages of raw materials, shortage of labour hire, Government decrees, proclamations or orders, transport difficulties, and failures or malfunctions of computers or other information technology systems.
Atomic Hot Water Repairs reserves the right to review and make changes to these terms and conditions at any time and without notice.
